Why waiting periods matter
You cannot apply for a record suspension until your waiting period is complete. Applying too early results in automatic rejection and wasted fees. This guide explains current Parole Board of Canada rules as of 2026.
Current waiting period rules
For first offences on or after March 13, 2012: summary convictions require 5 years; indictable offences require 10 years. The clock starts when your entire sentence is satisfied - fines, probation, restitution, and all court-ordered conditions.
Transitional rules (2010–2012)
Offences between June 29, 2010 and March 12, 2012 fall under transitional provisions. Some applicants qualify under older, shorter waiting periods. Verify your offence date during a free eligibility review.
When is your sentence complete?
Unpaid fines, active probation, outstanding restitution, or incomplete interlock programs all pause your eligibility clock. Obtain Proof of Conviction and confirm with the sentencing court if unsure.
